October 13, 2026. These terms take effect on this date and cover every purchase from then on.
1. Who We Serve and How You Accept
Toby Elwin, under the name Toby Elwin Advisory, runs tobyelwin.com and sells the products and services on it. In these terms, “Toby Elwin,” “we,” and “us” mean that business. These terms govern your use of the site, every template purchase, and every Clarity Session.
You accept these terms when you use the site, subscribe to the newsletter, buy a template, or book a session. A buyer who purchases for a company confirms the authority to bind that company. If you reject these terms, do not use the site or buy from it.
The Privacy Policy explains how Toby Elwin handles personal data and cookies, and it forms part of these terms.
2. Template License
Each template purchase grants you a personal, non-exclusive, non-transferable license to use that file. Toby Elwin keeps full ownership and copyright in every template.
You may:
- Use the template for your own work or inside the company that buys it.
- Edit the template, fill it in, and share the completed version with colleagues, clients, and stakeholders.
- Keep backup copies for your own use.
You may not:
- Sell, resell, license, give away, or publish the blank template, in whole or in part.
- Upload the template to a template marketplace, file-share site, course, or public repository.
- Remove the copyright notice or present the template as your own product.
- Share your download link with anyone outside your company.
A breach ends this license at once, with no refund. Toby Elwin enforces copyright and files takedown notices under the Digital Millennium Copyright Act.
3. Prices and Payment
Each product page and the checkout show prices in US dollars. Some templates let you name your price: you choose any amount at or above the stated minimum, and every amount buys the same file and the same license.
Stripe processes every payment. Toby Elwin never sees or stores your full card number. Stripe handles your payment details under its own terms and privacy policy.
You pay any sales tax, VAT, or bank fees that apply where you live. Toby Elwin may change prices at any time. A price change never affects an earlier order.
4. Delivery and Refunds for Templates
After payment, Toby Elwin sends a download link to the email address you enter at checkout. If the email fails to arrive within 24 hours, check your spam folder, then write to admin@tobyelwin.com with your receipt.
Template sales stay final once the file downloads. A digital file cannot return once delivered, so Toby Elwin offers no refund for a change of mind.
Toby Elwin fixes or refunds a faulty file. If a file arrives damaged, fails to open in a current version of Microsoft Excel, or differs from its product description, write to admin@tobyelwin.com within 14 days of purchase. Toby Elwin sends a replacement file. If a replacement fails too, Toby Elwin refunds your payment in full.
Buyers in the European Union and the United Kingdom. Consumers there hold a 14-day right to withdraw from an online purchase. For digital content, that right ends once delivery starts with the consumer’s consent. When you buy a template, you ask for immediate delivery and acknowledge that you lose your withdrawal right once the download begins.
Please contact Toby Elwin before you open a dispute with your bank. One email solves most problems.
5. The Clarity Session
The Clarity Session gives you 90 minutes of live advice over a video call. You pay the price shown at checkout, in full, before the call.

Session times. After payment, you choose a time for the call. Please return the questionnaire at least 24 hours before the call.
Cancellation and refunds.
- You may cancel or move the call free of charge up to 48 hours before it starts. A cancellation in that window earns a full refund.
- A cancellation or move within 48 hours of the call forfeits the session, unless Toby Elwin confirms a new time in an email.
- A missed call without notice counts as a delivered session.
- If Toby Elwin cancels, you choose a new time or a full refund.
- Once the call takes place, the session carries no refund.
No guaranteed outcome. The session delivers a diagnosis and recommendations. You decide whether and how to act on them, and results depend on your organization. Toby Elwin guarantees no business result.
Credit toward an Advisory Day. Toby Elwin credits the full session price toward an Advisory Day booked within 30 days of the call.
Confidentiality. Toby Elwin keeps what you share in the session confidential and never names you or your organization in public without your written permission. Share only information you hold the right to disclose.
Larger engagements. Advisory Day, Weekly Retainer, Transformation Sprint, and Keynotes run under a separate written agreement. That agreement, not these terms, governs those services.
6. Site Content, Newsletter, and Intellectual Property
Toby Elwin owns all articles, images, diagrams, frameworks, and templates on tobyelwin.com, unless a credit names another owner. You may quote a short passage with a link back to its source page. Do not copy or republish whole articles without written permission.
Newsletter. A subscription brings you one weekly email digest of new posts. Every email carries an unsubscribe link, and you may leave at any time.
Comments. When you post a comment, you give Toby Elwin permission to display it on the site. You keep ownership of your words. Toby Elwin may remove any comment for any reason, such as spam, abuse, or off-topic links.
Acceptable use. Do not scrape the site in bulk, interfere with its security, or use it to break any law.
7. No Professional Advice and Limits of Liability
General information only. Articles, templates, and session advice address management, transformation, and organizational practice. None of it offers legal, financial, tax, or investment advice. For those questions, consult a licensed professional.
As-is. Toby Elwin provides the site and the templates as they stand. Toby Elwin works to keep them accurate and available, but promises neither error-free content nor uninterrupted service.
Limit of liability. To the fullest extent the law allows, Toby Elwin’s total liability to you for any claim tied to the site, a template, or a Clarity Session never exceeds what you pay for that item in the 12 months before the claim. Toby Elwin accepts no liability for indirect or consequential loss, such as lost profit, lost data, or business interruption.
Some jurisdictions forbid these limits. Where the law gives you rights that no contract can remove, those rights still apply.
8. Law, Changes, and Contact
Applicable law. The laws of the State of North Carolina, USA, govern these terms, and the state and federal courts in North Carolina hear any dispute. A consumer in the European Union or the United Kingdom keeps the protection of the mandatory consumer laws where that consumer lives.
Changes. Toby Elwin may update these terms. The date at the top of this page shows the current version. Changes apply to purchases after that date, never to an earlier order.
Severability. If a court finds any part of these terms unenforceable, the rest still applies.
